FDA Regulatory Roundup: Breakthrough Approvals, Digital Health, and MoCRA Compliance Updates

Navigating the evolving landscape of federal healthcare regulations requires constant vigilance. Over the past week, the U.S. Food and Drug Administration (FDA) issued a few breakthrough approvals and rare disease initiatives.  As well as critical updates affecting medical device manufacturers, critical clarifications for industry and the public. And let’s not forget, shortage mitigation measures.

Below is an executive digest of the key regulatory decisions, public health actions, and industry guidance published by the FDA.

Breakthrough Approvals and Rare Disease Initiatives

First we have the accelerated approval for Biomarker-Guided Breast Cancer Treatment – In a major milestone for precision oncology, the FDA granted accelerated approval to AstraZeneca’s Etcamah (camizestrant) in combination with CDK4/6 inhibitors. This is specifically indicated for adult patients with HR-positive, HER2-negative, locally advanced or metastatic breast cancer carrying an ESR1 mutation.  This marks the first FDA drug approval guided by detecting resistance mutations in circulating tumor DNA (ctDNA) prior to radiographic disease progression. (The approval is supported by the Guardant360 CDx companion diagnostic assay.)

Secondly, we have the First-Ever Treatment for Alexander Disease!  The FDA approved Zanvastro (zilganersen).   This approval marks the first-ever regulatory approval for a disease-modifying treatment targeting Alexander disease in pediatric and adult patients.

Finally, the CDRH released it’s Rare Disease Impact Initiative.  The Center for Devices and Radiological Health (CDRH) officially launched the CDRH Rare Disease Impact Initiative. The program introduces a specialized Rare Disease Medical Device List and dedicated agency resources.  This tool is aimed at overcoming development hurdles associated with small patient populations and complex clinical trial designs.

Digital Health, MedTech, and Device Guidance

Updated Digital Health and AI Device Listings

U.S. Food and Drug Administration (FDA) periodically updates its searchable public listings.  To that end the CDRH refreshed its searchable databases of authorized medical devices. This update integrates advanced digital health technologies, including:

Clarifying PFAS Use in Medical Devices

In hopes of addressing industry and consumer questions, the FDA released new FAQs.  These FAQs specifically address per- and polyfluoroalkyl substances (PFAS) in medical technology. The agency clarified that high-performance fluoropolymers used in life-saving devices (such as catheters, cardiovascular implants, and wound care) differ significantly from environmental PFAS concerns and undergo rigorous biocompatibility evaluations.

Consumer & Clinical Safety for Clear Dental Aligners

The FDA published dedicated guidance highlighting that clear aligners are prescription medical devices requiring ongoing in-person evaluation and supervision by licensed dental professionals.  This resource advises against unmonitored direct-to-consumer models.  This guidance additionally supports the future vision of where FDA wants to see clinical over-site.

Regulatory Clarifications & Public Comments

MoCRA Update

FDA issued a clarification and update that it Does Not Issue Cosmetic Compliance Certificates. This clarification is particularly important as consumers are targeted on-line and it’s important for us all to share and educate those around us.  FDA’s clarification is addressing widespread misunderstandings among e-commerce sellers and retail platforms (such as TikTok Shop), as well as consumers.  The FDA explicitly clarified that it does not issue certificates, letters, or verification documents confirming cosmetic facility registration or listing exemptions under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). It is important that consumers understand that registration numbers do not constitute FDA approval or endorsement!

Request for Information: Botanical Drug Development

Under a new administrative initiative to streamline regulatory pathways, the FDA issued a Request for Information (RFI) seeking stakeholder input on advancing botanical drug products. The agency is inviting public comments through November 3, 2026, on key challenges surrounding quality standards, real-world evidence, and study design for complex plant-derived mixtures.  This is your opportunity to weigh in and have an impact!

Shortage Mitigation & Critical Safety Alerts

Action on Neonatal Starter Nutrition Shortages

Following the closure of two major compounding outsourcing facilities, the FDA published immediate-in-effect temporary guidance allowing state-licensed pharmacies and 503B outsourcing facilities to compound neonatal starter parenteral nutrition (PN) to prevent critical supply gaps in children’s hospitals.

High-Priority Device & Drug Recalls

We spotlight recalls to help us all in the industry stay aware and use this to help us reassess our product risk analysis, learn from our peers in industry and ensure we are bringing the most current, safe and effective solutions forward for patient care.

Key Executive Takeaways

  1. Biomarker Strategy is Moving Upstream: The approval of Etcamah signals an agency shift toward liquid biopsy (ctDNA) progression tracking before physical imaging shows disease spread.
  2. E-Commerce Compliance Verification Needs Adjustment: Cosmetics brands selling on third-party channels must inform platform account managers that official FDA registration “certificates” do not exist.
  3. Software & Hardware Integrity Remain Under Scrutiny: MedTechdevelopers must maintain rigorous post-market oversight over firmware updates and physical stress tolerances to prevent Class I recall enforcement actions.
